  • Who can file bankruptcy?

    Any person or business entity can file for bankruptcy protection. And while there is not a bright line test to determine whether one has enough debt to file bankruptcy, we are usually able to explain various options and the pros and cons to these options. However, at M.A. Munson Law, we want the decision as to whether or not to file bankruptcy to be entirely up to you. Unlike many other practitioners, our practice does not focus entirely on bankruptcy. Hence, we can give you an objective overview of all of your options and you can be assured that we will never pressure anyone – because our livelihood does not depend entirely upon the number of bankruptcy petitions that we file in a given month.

  • What if I have previously filed for bankruptcy?

    If you previously filed a Chapter 7 bankruptcy (and subsequently received a discharge), you must wait 8 years from the date of discharge before you may file another Chapter 7 bankruptcy. However, you may file for protection under Chapter 13 bankruptcy 4 years from the date your Chapter 7 bankruptcy was discharged.

    If you previously filed a Chapter 13 bankruptcy (and subsequently received a discharge), you must wait 6 years from the date of that discharge before you may file bankruptcy under Chapter 7. However, you may file for bankruptcy protection under Chapter 13 after 2 years have passed.
